Web page tule.ee (http://www.tule.ee) (further referred to as Web page) is a network project connecting people based on their studying or working place. When you register yourself as the user of the Web page you confirm that you have read these terms of use (further referred to as Rules), understood them and agree to follow them.

System administrators of tule.ee (further referred to as Administrators) reserve the right to change and(or) supplement the Rules at any time at their own discretion without prior or further notice. Administrators disclose the changes to these Rules on this Web page. Your further use of the Web page after all the changes made on this Web page means your agreement with those changes and(or) supplements. If you do not agree to follow the Rules, do not use this Web page and if you are a registered user, delete your account and(or) leave the Web page. It is your own responsibility to check this page regularly for detecting possible changes and examining the valid version of the Rules.

1. Registration data, account safety

When you register on the Web page and use the Web page, you undertake to:

Submit exact, current and full information about yourself asked from you in the registration forms of the Web page (Registration data);

Take into use all necessary measures for maintaining your user name (e-mail address) and password;

Update registration data and personal information submitted at registration regularly to guarantee that these are exact, current and complete;

Be fully responsible for any actions performed by you with your account and consequences occurred or might have occurred due to such use of the account.

2. Forbidden use of the Web page

The Web page is designed for your personal noncommercial use only. Using the Web page you confirm that you completely understand that materials placed on the Web page or by the help of it may potentially infringe the legally protected proprietary and(or) personal non-proprietary rights of third persons inter alia sole rights to the objects of intellectual property and may include information forbidden to be distributed by the laws of the Republic of Estonia.

On the Web page it is forbidden with these Rules to:

Collect or store e-mail addresses of the Web page users or other contact information automatically or in any other manner with the aim to send unsubscribed e-mails or other undesirable information (spam);

Use the Web page in any way that may hinder the regular operation of the Web page or its applications;

Use automatic scripts (programs) for collecting information and(or) cooperation with Web page and its applications;

Upload, disclose, forward or publish in any other manner (further referred to as place) any kind of information which includes threats, discredits or insults other users or third persons; is vulgar, improper, fraudulent, invades personal or public interests, provokes racial, religious, ethnical hatred and hostility or any other information violating the human and citizen rights;

Register more than one user account, register user account in the name of another person (false account), register an account for a group of people or company;

Mislead users about own personality, using an account of another person;

create knowingly misleading perception of him or herself, of user’s age or relations with other people or organizations;

Place any commercial advertisements, business proposals, campaigning materials, distribute spam, chain messages (messages requiring forwarding to one or several users), schemes of financial pyramids or calls to participate in them; any other intrusive information except in cases when placing this kind of information has been approved by the Administration;

Place on the Web page home addresses, phone numbers, e-mail addresses, passport data and other personal information of other users or any other third persons without their personal consent for those actions;

Place any files that may contain viruses or other damaging programs;

Describe or promote crime, place instructions or guidelines for committing crime;

Try to get an access to someone else’s account by any means including breaking into against the will of the owner of the account. Place any kind of information that violates the sole rights of users or third persons to the objects of intellectual property;

Place any kind of other information which according to the personal opinion of Administration is undesirable, does not meet the objectives of creating the web page, limits the interests of users or is undesirable for placing on the Web page for some other reasons.

Administration reserves the right to change (moderate) or remove at its own discretion any kind of information (including personal messages) placed by you that violates the conditions provided in clause 2 of the Rules at any time for any reason or without explaining the reasons; with or without prior warning suspend, restrict or terminate your access to the entire Web page or any of its parts or applications without responsibility for any damage that might occur to you with that action;

Administration persistently reserves the right to remove your account at its own discretion or restrict or terminate your access to the Web page applications if the Administration detects that according to its opinion you are a danger to the Web page and(or) its users.

3. Sole rights to the content placed on the Web page

All objects including design elements, effects, text, graphic images, illustrations, videos, scripts, software, music, sounds and other objects and options placed on the Web page, hence the content of the Web page (further referred to as Content) are the sole right objects of the Administrator of the Web page, users and other owners of the right. All rights to these objects are protected except in cases provided with these Rules and legislation valid in the Republic of Estonia. No Content can be copied (reproduced), processed, distributed, displayed on panes, disclosed, downloaded, transferred, sold or used in any other way as a whole or in parts without the prior consent of the owner except in cases when the owner of the right has distinctly declared its consent for free use of the material by any person.
Placing the Content on the Web page you give other users the none sole right for using it, i.e. viewing, reproducing (incl copying), processing (incl printing the copies), other rights – only for personal non-commercial use except the cases where that kind of use causes or may cause damage to the interests of persons protected by law.

Using the Content to which only you have been granted access for personal non-commercial use is allowed only when keeping all copyright or other messages referring to copyright and preserving the name of the author and the work without modifications.

Apart from placing your personal Content you do not have the right to upload or otherwise publish (disclose on Web page) the Content of other Web pages, databases and other objects of sole right in case of a lack of distinctly declared consent for those actions from the owner of the right. Any kind of use of the Web page or Content, except in cases allowed by these Rules or on distinct consent of the author (owner of the right) for that kind of use, is strictly forbidden without a prior written consent of the author.

In case a motivated claim arrives from the owner of the respective right about violation of his or her legally protected right, the Administration reserves itself the right to use measures provided in Clause 2 of the Rules against the violator.
If nothing else has been distinctly provided with these Rules, no provision of these Rules can be handled as transfer of the sole rights.

4. Responsibility for violating sole rights

You are personally responsible for any kind of Content or other information you upload or publish otherwise (disclose) on Web page or by the means of it. You cannot upload, forward or disclose the Content on the Web page if it is not created personally by you or for placing of which you do not have the consent from the owner of the right.
You understand and agree that the Administration can review the Page but is not obliged to do it to identify the existence of forbidden Content and may delete or relocate (without prior notification) any kind of Content or users at its own discretion for any reason or without reason including unlimited relocation or deletion of Content violating these Rules or rights of other users or third persons, harm them or threaten their security by personal opinion of the Administrator.

You are personally responsible for safekeeping the Content placed or stored on Web page (making backup copies).
By placing the Content on the Web page you authorize the Administration to make copies from your Content for maintaining and facilitating the disclosure and storing of the Content of the user on the Web page.

By placing your Content on any part of the Web page, you automatically give the Administrator the free non-sole right to use it for copying, public disclosure, reproducing, processing, translating and distribution for the aims of the Web page or in connection with them, including promoting the Web page. For the indicated aims the Administration may make derived works or add your Content as a part to respective collections, perform other actions necessary for achieving the specified aims. If you have decided to delete your Content, the rights specified in Clause 4 are automatically cancelled but you must consider that Administration may store the archive copies of the Content.

5. Web pages and Content of third persons

Web page contains (or may contain) hyperlinks to other web pages (web pages of third persons) but also articles, photos, illustration, graphic images, music, sounds, videos, information, applications, programs and other issues belonging to third persons or Content proceeding from third persons (Content of third persons).

Administration does not check the conformance of those third persons and their Content to these or other requirements (authenticity, completeness, honesty and other).
Administration shall not be responsible for any information placed on the web pages of third persons to which you gained access through Web page or Content of third persons, including any opinions or statements disclosed on the web pages of third persons or their Content.
Links of third persons placed on the Web page or instructions for downloading the files and(or) installing the programs do not mean supporting those actions or approval by the Administration; Hyperlink or reference to any Web page, product, service, and information with commercial or non-commercial character does not mean approval or recommendation of those products (services) by the Administration.

If you have decided to leave the Web page and go to the web pages of third persons or use or place the programs of third persons you are performing it at your own risk and from that moment these Rules shall not be valid any more. In your further relations you must be guided by the standards and policy used by those persons, incl commercial usage the Content of which you use.

6. Responsibility of users and Administration

You are personally responsible for the Content placed by you to the Web page, any information made available for the other users and cooperation with other users.
Administration does not perform obligatory checking (pre-moderation) about the Content placed by the user before disclosing it and the Content does not necessarily reflect the opinion of the Administration in respect of these or other issues.

Administration does not give any distinctly expressed or presumed warranties to any Content, its exactness, currentness or authenticity.
Since the Web page is with free access and not pre-moderated information resource, the Administration shall not be in any way responsible for the Content placed on the Web page or by means of the Web page by users or third persons.

Administration shall not be responsible for any behavior of the users or third persons using the Web page or examining it online or offline. Web page or its applications may be partly or fully inaccessible at one or another time for performing prevention or other works or other technical reasons. Administration is entitled to perform necessary preventive or other works at one or another time at its own discretion with or without prior notice.

Administration shall not be responsible for any mistakes, blunders, interruptions, deletions, defects, delays in data processing or transfer, communication line interruptions, theft, destruction or non legal access to materials of the users on Web page or any other place. Administration shall not be responsible for any technical failures of phone networks or services, computer services, server or content supplier, computer or phone equipment, software or other problems, interruptions of e-mail applications or scripts due to technical reasons.

Administration shall not be responsible for damages caused to the computer, mobile device or any other equipment of the user or other person caused by or related to downloading materials from the Web page or links placed to the Web page.

7. Limitations of responsibility of the Administration

Web page and its applications including scripts, web settings, account and Web page design is supplied “as it is”. Administration refuses from giving any warranties in respect of suitability or non-suitability of the Web page or its applications to specific aims of use. Administration cannot guarantee and does not promise any specific results from using the Web page and(or) its applications. To avoid misunderstandings you must take precautions in downloading and using any files including software of the Web page of hyperlinks placed there. Administration strongly recommends using only licensed software including the anti-virus software. Using the Web page you agree that downloading any material from or by the means of the Web page is performed at your own risk and you are personally responsible for consequences that may occur from using those materials including damage which may cause to your computer or the one of third persons, also for data loss or any other damage which may occur.

Administration reserves the right to change the design, its Content, list of applications of the Web page at any time, change and update used scripts, software and other objects used or stored at the Web page, any server settings and at any time with or without prior notice.

Web page administration shall not be responsible in any way for indirect, accidental, non-intentional damage including lost profit or lost data of you or third persons which may occur to somebody in connection with using services or materials provided here, or damage to honor, dignity or business image from using the Web page or content of the Web page or other materials you or other persons had an access by the means of the Web page even when the Administration warned or pointed to the possibility of such damage.

8. Final provisions

These Rules form an agreement between you and Administration about the procedure of use of the Web page and its applications and they replace all prior agreements between you and the Administration. This agreement is regulated and interpreted in accordance with the legislation of the republic of Estonia. Issues not regulated by the agreement shall be solved in accordance with the legislation of the Republic of Estonia. If for some reason one or several standards of these Rules become invalid or have no legal power, it does not influence the validity or applicability of other standards.
